As most informed people realize, concern about enactment of a compromise version of EFCA is being obscured by the smokeand haze being generated by the healthcare debate. But behind the scenes theSenate is still trying to craft a filibuster proof version of “labor law reform”and get it passed in this session of Congress. Just the other day, SenatorSherrod Brown (D-Ohio) emerged as a key Senate negotiator and, speaking on therecord, said it could pass the Senate this year. He acknowledgedworking hard to lobby both his Democratic and a few Republican colleagues toaccept a compromise.
Even more optimistic was Senator Tom Harkin(D-Iowa), the new chairman of the Senate Health, Education, Labor and Pensions(HELP) Committee and the point person for EFCA in the Senate. He said on aradio interview last week: “Hopefully we’re going to get the bill (EFCA)through sometime this fall, now that we hopefully have the 60 votes”, alludingto the replacement for Senator Kennedy.
Whether it happens in this calendar year or next,we believe some version of EFCA and ‘labor law reform’ will be taken up by theSenate. The time to learn about all the options and compromises beingconsidered is NOW. The time to develop your workplace preventivestrategies is NOW.
