NYC Salary History Ban Effective October 31

Tuesday, August 29, 2017

On October 31, 2017, the New York City Human Rights law will make it illegal for employers to inquire into an applicant’s salary history. The law makes it illegal to ask questions about salary history from either the applicant or the applicant's employer or former employers. It also makes it illegal to perform a search of public records to determine previous salary. The law provides for a private right of action as well as significant civil penalties. Employers should contact legal counsel to help them prepare for this new law and avoid these legal issues during the hiring process.
